We had a driver start having mechanical problems about 2 hours after picking up a load. he was still able to drive the truck so we kept him plugging along toward his destination. we sent another truck to meet him and switch out trucks. All this resulted in the load taking longer to reach its destination. The buyer was very upset and docked the rate drastically from $3000 to $1000. We don't feel like this is qiuite right. sometimes things go wrong but apparently this guy doesn't realize that. Just looking for some thoughts or ideas. |

He docked you $2000 dollars for being late? Holy crap. That sounds like robbery. How can that be legal? Were you days late? Just sounds crazy to me. |

Thats very excessive. I don't know the details, but I doubt there was $2000.00 worth of shrink. Sounds like a crooked buyer taking advantage of your misfortune to me. I'd call and raise hell!! Good Luck!! |

That is just outrageous! In my opinion you went above and beyond under the circumstances. Kept the trk moving, got a different truck under the load and still got it delivered. That buyer should be thankful you didn't dump the cattle at sale barn for who knows how many days until the trk was fixed! |

We got the load thru a broker so I dont know who the buyer is. the load was about 24 hours getting delivered on a 750 mile run. It could have been a lot worse in my opinion. thanks for the comments. |

Bruce - did you have a FRA document or a contract (written) with either party (broker or buyer)? If you did then you will have legal recourse against them. More than likely you will be seeking legal action against the broker or brokering agent and this can be a little more headache because you have a third party involved. Don't let this cause you to do nothing, doing nothing only allows them to continue these types of business practices and it hurts "our" industry! | REPLY REPLY WITH QUOTE |

I agree Richard, post their name or names and let everyone know. We need to get rid of those kind of shippers or buyers. I know, I also brand inspect and could give you several names of men not to take any loads from in the west. | REPLY REPLY WITH QUOTE |

He just used your problems to steal from you. None of my customers would do anything like that. I would call them right away and explain what's happeneing and what I'm doing to fix it. You did exactly the right thing in keeping the truck moving and sending another. In such a situation, after we deliver the cattle, I'll ask if I need to adjust the freight. They nearly always say no, they understand. Keeping them in the loop is crucial. That, and not having it happen very often is important too. $2000 deduct is excessive to say the least. |

Steve - you gave him excellent advice! I agree with everything you and Richard advised him to do. Since this apparently has been settled(?) and it appears that he's received "partial" payment, in my opinion he needs to collect on the rest of the payment entitled to him. How he does this is strictly up to him, but don't lay down and take it! Seeking legal action is costly as we all know, however it's one of the best resource in collecting any debt owed to us. It will also deal with the criminal aspect of this which will remove this individual or agencies from our industry. | REPLY REPLY WITH QUOTE |
